The UK Building Safety Act was passed in April 2022. Commentators have flagged this legislation as a seismic change in UK construction operations. While some provisions became applicable immediately, the majority of them will be enacted through secondary legislation following a consultation process which is currently underway in the UK.

The legislation arises because of the Grenfell tragedy, the issues which have been brought to light in the various enquiries and the political pressure to address not only the reasons for the tragedy, but the ability of the Grenfell victims to hold responsible parties accountable for the consequences of the tragedy.

• provide an overview of the implications of the BSA and flag the headline provisions

• look at legal responsibilities for those involved in the construction and occupation phases, the golden thread, registration requirements, potential offences and liabilities.

• outline practical considerations relating to compliance, pitfalls and areas likely to create uncertainty, and how best to mitigate the risks under the new regime.

• consider updates required to construction contracts including building contracts, appointments and warranties given the implications of the new legislation

• review the provisions relating to Remediation and Building liability orders, piercing the corporate veil and who pays.

• take a look at the implications for developers and contractors of the ‘Cladding pledge’ and the ‘Developer’s Contract’ both of which are attracting considerable attention;

• detail the changes to the Defective Premises Act arising from s.38 of the Building Act amendments / additions with particular regard to extended liability periods and retrospective effect

• compare the proposed ‘gateways’ to compliance with the BSA with the existing Irish BCAR regime
